Terms of Service

These terms govern your use of BushNav — the app, the web app, and this website. BushNav is operated privately from Australia ("BushNav", "we", "us"). By creating an account or using BushNav, you agree to these terms.

1. Using BushNav

We grant you a personal, non-transferable, non-exclusive licence to use BushNav for your own private, non-commercial use, subject to these terms. You must be able to form a legally binding contract to create an account. You're responsible for keeping your account credentials secure and for all activity under your account.

2. Subscriptions

BushNav Pro is an auto-renewing subscription (currently offered as bushnav_pro_yearly) purchased and managed entirely through Google Play Billing. This means:

• Payment is processed by Google — we never receive or store your card details.
• Your subscription renews automatically at the price and interval shown at purchase, unless you cancel before the renewal date.
• You manage, cancel or change your subscription through the Google Play Store, not through BushNav directly.
• Price changes are handled by Google Play in line with Google's own policies, and you'll be notified before any change takes effect.
• Refunds are handled under Google Play's refund policy, except where the Australian Consumer Law entitles you to a remedy from us directly (see section 3).

3. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (ACL), or any other law, that cannot lawfully be excluded, restricted or modified. Our services come with guarantees that cannot be excluded under the ACL. Where we're permitted to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to re-supplying the service or paying the cost of having it re-supplied.

4. User-generated content

BushNav lets you submit reviews, ratings, photos, track condition reports, and suggested POIs or tracks ("user content"). By submitting user content, you grant BushNav a non-exclusive, royalty-free, worldwide licence to host, store, reproduce and display that content within BushNav for the purpose of operating the service (for example, showing your review to other users).

You retain ownership of your user content, and you're responsible for it. Your content must not be illegal, defamatory, infringe someone else's rights, or be knowingly false or misleading — including reporting a track or crossing as safe or passable when you have no reasonable basis to believe that's true. We may remove content, or suspend or terminate accounts, that breach these terms or our Community Guidelines.

5. Acceptable use

You agree not to: use BushNav for any unlawful purpose; scrape, harvest or bulk-extract data from the app, web app or this website; attempt to interfere with, disrupt or gain unauthorised access to BushNav's systems; impersonate another person or misrepresent your affiliation; or submit navigation-relevant information (track conditions, crossing status, closures) that you know to be false or reckless.

6. Safety disclaimer — please read this

BushNav is a planning and navigation aid. It is not a substitute for your own judgement, preparation, and local knowledge, and it is not a guarantee of safe passage. In particular:

• Track conditions, water crossings, road closures and weather in remote and off-road areas can change quickly and without notice, and may not be reflected in BushNav.
• Much of BushNav's data — including tracks, POIs, reviews and condition reports — comes from OpenStreetMap and the BushNav community, and may be incomplete, outdated or incorrect.
• You must independently check official and local sources before and during remote travel (for example, state park authorities, road condition services, and the Bureau of Meteorology), carry appropriate supplies, safety and communication equipment, and not rely solely on BushNav when travelling in remote areas.
• You use BushNav, and any route, track or POI information within it, entirely at your own risk.

To the maximum extent permitted by law, BushNav makes no warranty that any map, track, POI, condition report or other data within the app is accurate, complete or current. See our Safety Disclaimer for a plain-English summary.

7. Intellectual property

The BushNav name, logo and app (excluding the underlying map data described below) are owned by BushNav. Map and place data displayed in BushNav is derived from OpenStreetMap, © OpenStreetMap contributors, licensed under the Open Database Licence (ODbL) — you're free to use that underlying data subject to ODbL's terms. Map tiles are supplied by our map tile provider under their licence terms. BushNav does not claim ownership of OpenStreetMap data or the map tiles.

8. Liability

To the maximum extent permitted by law, and subject to section 3 above, BushNav is not liable for any loss, damage, injury or expense (including indirect or consequential loss) arising from your use of, or inability to use, BushNav, or your reliance on any information within it — including while travelling, driving or navigating in remote or off-road areas. This limitation does not apply to any liability that cannot lawfully be excluded, including your rights under the Australian Consumer Law.

9. Termination

You may stop using BushNav and delete your account at any time from within the app. We may suspend or terminate your access if you breach these terms, our Community Guidelines, or use BushNav in a way that risks harm to us, other users, or third parties.

10. Changes to these terms

We may update these terms as BushNav's features change. We'll update the "last updated" date above when we do. Continuing to use BushNav after an update means you accept the revised terms.

11. Governing law

These terms are governed by the laws of Australia. Any dispute arising from these terms or your use of BushNav is subject to the non-exclusive jurisdiction of the Australian courts.
